Durante años, inversionistas adinerados aprovecharon vacíos del sistema de impuestos a la propiedad para canalizar dinero de escuelas y gobiernos locales hacia sus propios bolsillos. Pero esas lagunas se cerraron después de que un estudio de la Tesorería del Condado Cook puso bajo escrutinio la costosa ley estatal de “venta por error”, una norma que los propios inversionistas ayudaron a diseñar.

El estudio reveló que fondos de cobertura, firmas de capital privado y otros compradores de deuda tributaria desviaron casi $280 millones de agencias gubernamentales del Condado Cook a lo largo de siete años, comenzando en 2015. Y el 87% de ese dinero provino de comunidades negras y latinas de menores ingresos.

Se trata de más de un cuarto de billón de dólares que debieron destinarse a financiar escuelas, parques, policía, obras públicas y otros servicios esenciales, pero que terminaron en manos de compradores de impuestos adinerados.

Los investigadores encontraron que estos compradores explotaban supuestos “errores” para salirse de operaciones que normalmente los habrían obligado a asumir la propiedad de un inmueble con impuestos atrasados.

Así funciona el proceso: cuando un propietario no puede pagar sus impuestos a la propiedad dentro de los 13 meses posteriores a la fecha de vencimiento, la deuda impaga puede subastarse en la Venta Anual de Impuestos del condado.

Entra en escena el comprador de impuestos, quien paga al condado lo adeudado en impuestos atrasados a cambio de un gravamen o derecho de cobro sobre la propiedad. Estos inversionistas buscan ganar dinero cuando la deuda se paga con intereses. Si la deuda no se paga, el comprador puede quedarse con la propiedad. Pero, por lo general, no están interesados en ser dueños ni en rehabilitar inmuebles. En su lugar, buscan salir del trato —a menudo con los intereses acumulados sobre lo que pagaron inicialmente— solicitando al tribunal que declare que la venta de impuestos se realizó por error.

El estudio sobre las ventas por error mostró que los compradores recuperaron su dinero con intereses por razones frívolas, como:

  • Una casa figuraba como construida en estuco cuando en realidad era de ladrillo.
  • Un edificio comercial de dos pisos aparecía registrado con cero pies cuadrados.
  • Una vivienda figuraba como si no tuviera aire acondicionado cuando sí lo tenía.

Iglesias, edificios gubernamentales y otras propiedades exentas de impuestos también fueron incluidas erróneamente en ventas de impuestos.

Algunos compradores manipularon el sistema al identificar posibles ventas con errores antes de adquirir los gravámenes, con la intención de pedir al tribunal una venta por error después de dejar que los intereses legales se acumularan durante años.

A partir de los hallazgos del estudio, el equipo de la Tesorería trabajó con legisladores de Illinois para reescribir la ley y limitar la capacidad de los compradores de impuestos de retirarse de los acuerdos alegando errores insignificantes en la descripción de las propiedades.

Y el trabajo continúa. El equipo de políticas de la Tesorería se reúne regularmente con legisladores en Springfield para impulsar reformas al sistema de impuestos a la propiedad, con el objetivo de hacerlo más equitativo y transparente.
